These Terms govern your use of Vivamo Play. By creating an account or using the platform you agree to be bound by them. Please read them carefully — they include important information about your rights and obligations.
01. Acceptance of Terms
By accessing or using the Vivamo Play platform, website, or any associated services (collectively, the "Platform"), you confirm that you have read, understood, and agree to be bound by these Terms of Service ("Terms") and our Privacy Policy. If you do not agree, you must not use the Platform.
These Terms constitute a legally binding agreement between you and Vivamo Inc ("Vivamo Play", "we", "us"), a company incorporated in the United States with its principal place of business at 708 Main St, 10th Floor, Houston, TX 77002. 02. Eligibility
You must be at least 18 years of age to create an account and make purchases on Vivamo Play. Players aged 14–17 may browse public content but require verifiable parental or guardian consent to register. We reserve the right to request proof of age at any time.
By registering, you represent and warrant that all information you provide is accurate, current, and complete. You may not use the Platform if you have previously been suspended or removed by us.
03. Accounts
Registration
You may register using an email address and password, or via supported third-party single sign-on providers (Google, Apple). You are responsible for maintaining the confidentiality of your credentials and for all activity under your account.
Username
Usernames are public and permanent once chosen. We reserve the right to reclaim usernames that impersonate others, are offensive, or that violate these Terms. You may not transfer your account to another person.
Account deletion
You may delete your account at any time from account settings. Deletion initiates a 30-day soft-delete period during which charms held in your collection are returned to the marketplace. After 30 days, your account data is permanently deleted in accordance with our Privacy Policy. Purchases made prior to deletion are non-refundable.
04. Platform Mechanics
Charms
Digital charms on Vivamo Play are purely cosmetic and collectible — they confer no in-game utility, monetary value, or rights beyond their use within the Platform. Charms are licensed to you, not sold. All intellectual property rights in charm artwork remain with Vivamo Play or the applicable partner studio.
Demand-triggered relinquish
Original charms held in your collection are subject to a demand-triggered relinquish window. If a charm reaches 10 or more players on its wishlist, a 30-day relinquish window begins. You will receive relinquish requests at day 0, day 15, and day 23. If no action is taken, the original auto-relinquishes on day 30 and is relisted on the marketplace. Charms with fewer than 10 players on the wishlist are held indefinitely with no expiry. If you have already minted a personal copy, you keep it permanently — relinquishing only returns the original to circulation.
Claim limits
Claims from the marketplace are capped at 3 per player per day. Claim windows are simultaneous for all users. No UI element creates a pay-to-win advantage.
Mint-and-relinquish
When you claim an original charm from the marketplace you have two options. You may mint a personal copy — your minted copy is added to your collection permanently and counts toward set completion, while the original is immediately returned to the marketplace. Alternatively, you may hold the original — it remains in your collection and counts toward set completion, but is subject to demand-triggered relinquish rules. You may mint a copy at any point while you hold the original. Minted copies cannot be listed on the marketplace and are not subject to expiry.
Duplicate minting
In rare circumstances where a charm edition is fully held and blocking set completion for multiple players, Vivamo Play may mint a second copy of that charm. The original holder retains their copy. Duplicate minted charms are visibly marked as "2nd edition". Minting decisions are logged and governed manually by our operations team.
Sticker sheets
Completing a full set of 25 charms unlocks a downloadable sticker sheet. This is a digital file licensed for personal, non-commercial use only. You may not reproduce, sell, or distribute sticker sheets for commercial purposes.
05. Purchases & Payments
Products
Vivamo Play offers the following digital products, all priced in United States Dollars (USD) and delivered electronically through the Platform:
- Pack 1 — Starter ($5.00 USD): 1 starter charm credit, redeemable for any 1 starter charm from the current theme catalogue. Unlocks access to that theme's limited charm collection on the marketplace.
- Pack 2 — Dual ($10.00 USD): 2 starter charm credits, redeemable across any 2 themes. Unlocks simultaneous access to 2 theme collections.
- Pack 3 — Collector ($20.00 USD): 4 starter charm credits, redeemable across any 4 themes. Unlocks simultaneous access to 4 theme collections.
- Pack 4 ($25.00 USD): 5 starter charm credits — access to 5 themes.
- Pack 5 ($50.00 USD): 10 starter charm credits — access to 10 themes.
- Pack 6 — Full Access ($100.00 USD): 20 starter charm credits — access to all 20 launch themes simultaneously.
All prices are displayed and charged in USD. Charm credits are applied immediately upon successful payment. Starter charms are digital collectible items with no monetary value, no in-game utility, and no guarantee of resale value.
Payment
All purchases are processed via Stripe. By completing a purchase, you authorise Vivamo Inc to charge the payment method you provide.
All purchases are final and non-refundable once starter charms have been applied to your account, except where required by applicable consumer protection law. If you believe a charge is in error, contact support@vivamoplay.com within 14 days.
06. Minting & Relinquishing
Minting a personal copy
When you hold an original charm, you may mint a personal copy at any time from the charm detail screen. Minting is a deliberate, irreversible action. Once minted, the original is immediately returned to the marketplace and you retain the minted copy permanently. Minted copies count toward set completion and are not subject to expiry or relinquish requests. Minted copies cannot be listed on the marketplace.
Voluntary relinquish
You may voluntarily return an original charm to the marketplace at any time from the charm detail screen, whether or not a relinquish window is active. If you have already minted a copy of that charm, you retain it. Voluntary relinquish is always available and always your choice. We will never pressure you to relinquish — holding an original is completely valid.
Demand-triggered relinquish
If 10 or more players add a charm you hold to their wishlist, a 30-day relinquish window begins. You will receive informational notifications at day 0, day 15, and day 23 of the window. If the original has not been minted or voluntarily relinquished by day 30, it auto-relinquishes and is relisted on the marketplace. No penalty is applied — auto-relinquish is a circulation event, not a punishment.
Set-locked charms
Minted copies that form part of a completed set are set-locked. Set-locked charms count toward your sticker sheet download and cannot be relinquished.
07. Intellectual Property
All content on Vivamo Play — including but not limited to charm artwork, logos, brand elements, sticker sheets, and platform code — is owned by or licensed to Vivamo Inc. You are granted a limited, non-exclusive, non-transferable licence to access and use the Platform for personal, non-commercial purposes.
Partner studio charm artwork remains the intellectual property of the respective studio. Vivamo Play is licensed to display and distribute such artwork within the Platform.
You may not copy, reproduce, modify, create derivative works from, or commercially exploit any Platform content without our express written consent.
08. Prohibited Conduct
You agree not to:
- Use automated scripts, bots, or other tools to claim charms or interact with the Platform at speeds that exceed normal human interaction
- Create multiple accounts to exploit claim limits or platform safeguards
- Impersonate any person, entity, or Vivamo Play staff
- Attempt to reverse-engineer, decompile, or exploit Platform systems
- Harass, threaten, or abuse other players through any platform interaction
- List, sell, or exchange charms for real-world currency outside the Platform
- Circumvent any security, rate-limiting, or access control measures
09. Termination
We may suspend or terminate your account at any time and for any reason, including breach of these Terms. On termination, original charms in your collection are returned to the marketplace. Minted copies in your collection are forfeited. We will endeavour to provide notice where practicable, but reserve the right to act immediately for serious violations.
10. Limitation of Liability
The Platform is provided "as is" without warranty of any kind. To the fullest extent permitted by law, Vivamo Play excludes all liability for indirect, incidental, or consequential losses arising from your use of the Platform, including loss of charms due to account termination, technical failures, or expiry mechanics.
Nothing in these Terms excludes liability for death or personal injury caused by our negligence, fraud, or any liability that cannot be excluded by law.
11. Disputes & Governing Law
These Terms are governed by the laws of the State of Texas and the federal laws of the United States of America. Any dispute arising from or in connection with these Terms shall be subject to the exclusive jurisdiction of the state and federal courts located in Harris County, Texas, unless mandatory consumer protection laws in your state or country of residence provide otherwise.
Before initiating formal proceedings, you agree to contact us at legal@vivamoplay.com to attempt to resolve any dispute informally within 30 days.
12. Products & Pricing
Vivamo Play sells digital starter charm packs as described in Section 05 above. All products are intangible digital goods delivered electronically. There are no physical goods, no shipping, and no delivery timeframes associated with any purchase. All prices are listed and charged in United States Dollars (USD).
Vivamo Inc reserves the right to update pack pricing at any time. Price changes will not apply to purchases already completed. Any promotional pricing is subject to separate terms communicated at the time of the promotion.
13. Delivery
All Vivamo Play products are digital goods delivered electronically. Upon successful payment:
- Starter charm credits are applied to your account immediately and are available for redemption without delay.
- Your selected starter charm(s) appear in your collection within seconds of redemption.
- Downloadable sticker sheets (awarded upon set completion) are generated server-side and available for immediate download from your collection page. Sticker sheets are stored for up to 12 months and may be re-downloaded at any time during that period.
Because all products are delivered digitally and instantly upon payment, there is no physical shipping, no carrier involvement, and no delivery window. If your purchase does not appear in your account within 10 minutes of payment confirmation, please contact us at support@vivamoplay.com or call (346) 271-7446 and we will resolve the issue promptly.
14. Refund Policy
Because Vivamo Play sells digital goods that are made available immediately upon purchase, all sales are generally final. By completing a purchase, you acknowledge and agree that:
- You are purchasing an intangible digital product (starter charm credit) that is applied to your account at the time of payment.
- Digital delivery begins immediately upon successful payment confirmation.
- You expressly consent to the immediate supply of the digital content and acknowledge that, as a result, you waive any right of withdrawal or cooling-off period that might otherwise apply under applicable consumer protection law, to the extent permitted by law.
Eligibility for refund
Notwithstanding the above, we will issue a full refund in the following circumstances:
- Your payment was processed successfully but charm credits were not applied to your account and we are unable to resolve the issue within 5 business days.
- You were charged in error (e.g. duplicate transaction, incorrect amount).
- Applicable US consumer protection law requires a refund in your jurisdiction.

Please include your username, the date of purchase, the amount charged, and your Stripe payment reference (found in your receipt email). We aim to respond to all refund requests within 3 business days and to process approved refunds within 5–10 business days via the original payment method.
Please note: Refunds are not available for charm credits that have already been redeemed (i.e. applied to a starter charm in your collection), for sticker sheets that have been downloaded, or for accounts that have been suspended or terminated due to breach of these Terms.
15. Changes to These Terms
We may update these Terms from time to time. Material changes will be notified to you via email or in-app notification at least 14 days before they take effect. Continued use of the Platform after that date constitutes acceptance of the revised Terms. We will always maintain a version history of past Terms on this page.
